In California, Public Recording of Conversations is Legal If There Was No Reasonable Expectation of Privacy By Michael P. Ehline, Esq. – First, let me start off by saying that I love the police and that many of my Marine Corps. brothers are now Deputy Sheriffs, or CHP. I am pretty sure at least one Redondo Beach K-9 cop is also an inactive Marine. So the bad things I am about to say about bad cops, is about BAD Cops, not the good ones. In the Corps, we called them “sh+*birds”. Now that is out of the way, let’s delve into the law. First, we will discuss the recording of non police, so we can get a baseline and basic understanding of California privacy laws and then we will go into the police. So, in California, if you record a private person, and they don’t know, even if in a public, or even a semi-public place such as a out on the sidewalk, bike path, or eating establishment, the individual you are taping, may not have “an objectively reasonable expectation that no one is listening in or overhearing the conversation.” This is determined on a case by case basis, based upon the reasonableness of the circumstances. This means you cannot simply assume that you are not breaking the law, when you make a recording of a person, under such circumstances. In California Can I Record The Police With Video? The internet, especially Youtube, has shown both the good, and the bad side of police, especially the TSA goons at the airports. Many agencies, although having received multiple citizen complaints against certain rogue officers, simply chose to act as though there was not a problem with their personnel ignoring their sacred oath(s). These are other ones that do not make it to the internet, because no one is there to exercise their First Amendment Rights, or the recorder gets stomped, or confiscated and erased. When All Else Fails Penal Code Sec. 148 PC Sec. 148 is the favored section bad cops use to charge people who the police had just violated, such as civil rights violations and excessive use of force. It is a common practice by bad cops to charge someone they just beat, or violated, with a crime, so they can get leverage in a future civil case if they are sued, and to give the police union some firepower when they are trying not to get terminated for being a bad cop. If an arrested criminal defendant pleas out to the false charge (no contest, not guilty, etc) out of fear, or for lack of money to pay a lawyer, or are “strong armed” by the public defender, etc, the officer can later argue reasonable force or methods were used, and that it is res judicata, etc. in any future civil rights lawsuit. This is the favored method they historically have used, and it is very effective at restricting the unalienable rights of the sovereign (you). Filming our Public Servants Helps Keep them Honest The good news is law enforcement officials are protecting citizens Constitutional rights. One example of this occurred during Thanksgiving weekend at an airport in Albany. A grassroots movement was there informing travelers about the dangers of TSA bodyscanners and filmed the encroaching pat-downs at the Albany International Airport. One airport official demanded the activists stop filming, show their identification and be arrested for breaking the law. Local law enforcement were called to the scene, where the sheriff told the airport official that the activists were not breaking the law, and he could not arrest them or order them to show their identification. This is no surprise, since the Sheriffs almost universally understand that many federal enforcement officials trample on individual rights as a matter of course. The sad part about this is not all members of law enforcement will behave in this manner as did the Shire of the Reef above. In most cases, threats of arrest and intimidation by law enforcement is usually enough to make the activist or individual stop filming. The one thing to remember, it is legal to film the police. People In San Francisco Are Pissed Over These Electric Scooters (HBO)

Inspired by Uber and Lyft — and even hiring some of the rideshares’ executives — a handful of companies are scattering electric scooter across cities first, then waiting for the law to deal with them. It’s an idea promoted by former Uber CEO Travis Kalanick called “principled confrontation.” Euwyn Poon, cofounder of electric scooter company Spin, refers to it as “innovating on the regulatory side.” City officials called it something else: “illegal business activities.” In Santa Monica in September, Bird put scooters on the streets, allowing customers to unlock them with a proprietary rideshare app. Santa Monica responded by filing criminal charges against the company, which were ultimately dismissed when the company pleaded no contest and agreed to pay $300,000 in fines. In San Francisco this month, the electric scooter companies, first LimeBike and Spin, then Bird, again distributed scooters across the city, and all three companies have argued neither city had rules in place to regulate their particular mode of transportation. The companies see it as an emissions-free solution to the “last mile” often walked on foot or taken on a rideshare after using public transit. Residents complain that riders take the scooters on sidewalks and leave them parked across sidewalks, blocking ADA ramps and tripping unsuspecting pedestrians. Since their rollout, the companies have been negotiating with Santa Monica and San Francisco on how scooters should be regulated, and how the companies can get their riders to follow the rules. In this video, Professor Sukkary testifies before the California Assembly Budget Subcommittee 5 on the need for openness and transparency at the California Commission on Judicial Performance (CJP), the state's judicial disciplinary agency. The commission’s meetings are neither open to the public nor subject to the California Public Records Act. Not even the CJP clerical staff is allowed to attend the complaint decision meetings. The commission has also exempted itself from Article 1, Section 3 (b) of the CA Constitution (regarding public meetings of public bodies and writings of government agencies), California Rules of Court, rule 10.500 (the judicial branch’s equivalent to the public records act), and the Bagley-Keene Open Meeting Act. The lively legislative hearing took place on March 28, 2016.

Knowingly depriving the public GOV 54959

Perhaps the SMUD Board members are unaware of the requirements of the Brown Act meeting laws that require the Board to make available without delay, any writings distributed to a majority of Board members? Perhaps the Sacramento County District Attorney should look into SMUD meeting practices? In the video, I repeatedly request to know what the presentation contains that was distributed to the SMUD Board and is claimed to be my alternate rate proposal that the Board is viewing at the meeting. I was not allowed to do so. SMUD Board Present Gregg Fishman did not comply with my request. Mr. Fishman, the presiding office and chair at the meeting did not comply with my GOV 54957.5 request to inspect the alternate rate proposal that was claimed to be my proposal. Mr Fishman used threat of arrest to try stop me from requesting the writings distributed to the Board for consideration at the meeting. What was supplied was a paper that had words and images similar to my proposal, without the ability to play the video content of my proposal. Each member of a legislative body who attends a meeting of that legislative body where action is taken in violation of any provision of the Brown Act, and where the member intends to deprive the public of information to which the member knows or has reason to know the public is entitled under this chapter, is guilty of a misdemeanor. As seen in this youtube video, when I request to inspect the writings that were distributed to the Board, the request was not fulfilled without delay as required by GOV 54957.5 and another threat of arrest of made by SMUD Board President Gregg Fishman. Alleged violation of GOV 54957.5. (a) Notwithstanding Section 6255 or any other law, agendas of public meetings and any other writings, when distributed to all, or a majority of all, of the members of a legislative body of a local agency by any person in connection with a matter subject to discussion or consideration at an open meeting of the body, are disclosable public records under the California Public Records Act (Chapter 3.5 (commencing with Section 6250) of Division 7 of Title 1), and shall be made available upon request without delay. However, this section shall not include any writing exempt from public disclosure under Section 6253.5, 6254, 6254.3, 6254.7, 6254.15, 6254.16, 6254.22, or 6254.26. GOV 54959 requires that there be a violation of the Brown Act at a meeting where action is taken where a member intends to deprive the public of information to which the member knows or has reason to know the public is entitled under the Brown Act. If so they are guilty of a misdemeanor. The SMUD rules SMUD General Counsel Laura Lewis uses to justify removal of the video content of my proposal shows the Board's intent to deprive the public of the contents videos provided by the public to the Board under PUC 14403.5 at their meetings. See 14403.5 https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=PUC&sectionNum=14403.5. SMUD has not provided me with the rules Ms. Lewis used to justify the removal of the video from my posted proposal. The SMUD Board continues deprive the public at the meeting the content of the video in my alternate rate proposal. This secret video is effectively kept secret by Ms. Lewis removing the video from the proposal placed on the SMUD website and not placing a notice it has been altered by removing the video or how the obtain the proposal in full. A closed road, a government contract opportunity, and the process by which Commissioners make a decision... all are important issues. Quorum discussions may take place ONLY in open public session. It's state law. According to the Oregon Open Public Meeting Law, the Com- missioners are herein engaged in an illegal activity which has been captured on this videotape. Oregon Open Public Meetings Law ORS 192.620 Policy: "The Oregon form of government requires an informed public aware of the deliberations and decisions of governing bodies and the information upon which such decisions were made. It is the intent of ORS 192.610 to 192.690 that decisions of governing bodies be arrived at openly. [1973 c.172 S1]" The Oregon Attorney General's Public Records and Meetings Manual 2010, Section II.C.1.b.: "Even an informal 'get together' [is] subject to all of the require- ments of the meetings law (notice, minutes, etc.), if a quorum of the commission discusses matters that are within the author- ity granted to that body. It does not matter that the discussion is 'informal' or that no decisions are made; it is still a 'meeting' for purposes of the Public Meetings Law." "Even if a meeting is for the sole purpose of gathering informa- tion to serve as the basis for a subsequent decision or recom- mendation by the governing body, the meetings law will apply." "This requirement serves the policy expressed at ORS 192.620 that an informed public must be aware not only of the decisions of government, but also of 'the information upon which such de- cisions were made.' Canyon Lake Property Owners Association Stops member from entering POA Meeting

When Sean arrived at the March 2nd. Board meeting, the Board once again hired extra security guards to stop Sean McDonald from entering an Open Board meeting on March 2, 2015 in direct violation of his rights under Davis Sterling and the current CLPOA by-laws. They revised our by-laws to disenfranchise two people and now more than 1,000 homeowners will no longer be allowed to serve on the Board. They eliminated "Associate Member" for all member who title their property via an Corporation, LlC etc. REASON for recalling board members: Dave Eilers, Doug Gordon, Bruce Yarbrough: 1. Violated their Fiduciary Duties to the membership. 2. Violated our governing documents. 3. Creating new rules for members that were not previously approved by the Board or the Membership. 4. Denied CLPOA membership even though the members had complied with approved CLPOA rules for CLPOA membership. 5. Orchestrated a new revision of By-laws to disenfranchise more than 1,000 property owners. The proposed By-laws significantly changes property rights or rights of members in an association without a legitimate newly created or recognized need. 6. Prohibited CLPOA members from attending POA board meetings in violation of the Davis-Sterling Act and our current by-laws. Sean has started a recall of Director's Eilers, Yarbrough and Gordon. For more than forty years Californians have been served by a capable 9-1-1 system. Recently, California published the California 9-1-1 Strategic Plan to emerge as a nationwide leader in the 9-1-1 community. California's commitment to NG9-1-1 continued by creating a proposed California NG9-1-1 Roadmap that outlines the steps necessary to design and build a robust and comprehensive NG9-1-1 system. The US Department of Transportation (US DOT) has conducted efforts at the national level to understand the impact of Next Generation 9-1-1 (NG9-1-1) and recently the Federal Communications Commission (FCC) initiated a request for commentary on issues related to implementing NG9-1-1. In 2009, the California 9-1-1 System handled 24.8 million calls alone. However, while the current 9-1-1 system has functioned efficiently for many decades, the core infrastructure is built on a legacy telephony-based platform unable to support new demands and capabilities. Widespread adoption of rapidly advancing technologies like text, video, Voice over Internet Protocol (VoIP) and the saturation of high-speed broadband access has raised the expectations of 9-1-1 services for Californians. Improvements are needed to support new requirements and expectations. To that end, California is seeking comment on topics related to NG9-1-1.

Using California environmental law to protect the poor - CEQA as public health tool

http://www.cafwd.org When we attended the recent Planning and Conservation League (PCL) meeting on the California Environmental Quality Act (CEQA), there were, as you might expect, a roomful of environmentalists who were there to defend the 42-year-old landmark California environmental law. There was also a group that was a bit surprising: The Physicians for Social Responsibility - Los Angeles. Their executive director, Martha Arguello, told us that her group has used CEQA to fight infill developments in Los Angeles, the expansion at the University of Southern California and the CEQA exemption for the planned new NFL Stadium in Los Angeles. She said that many poor people have been and will be impacted by these projects, and one of those impacts is on the health of the residents who are uprooted. Arguello thinks projects like this should demand a CEQA health impact analysis which they currently don't require: CEQA modernization was one of seven Signature Initiatives recommended by the California Economic Summit. We are following events in Sacramento and around the state as the Legislature prepares to act on the 42-year-old state environmental law.

California peace officers are (unconstitutionally) authorized to perform Penal Code 12031(e) inspections of firearms carried in public to determine if they are unloaded and in compliance with the (unconstitutional) state law. Many peace officers around the state believe they are required by law to check all firearms carried publicly. This is false and should be addressed with additional training. The peace officer in this video is one of Livermore's finest. He supports the 2nd Amendment and has no qualms about law abiding people openly bearing arms. He understands that he derives his authority from the People and he is a good steward of that authority. He deserves our respect. Notice how the peace officer observes the open carrier, lets his presence be known, responds with a polite greeting when prompted to do so and decides to respect the open carriers 2nd Amendment right to bear arms along with his 4th Amendment right to be secure in his person/effects. The California Police Chief's Association and the Peace Officer's Research Association of California have mislead the public and made the false claims that open carry is a threat to police officers and it wastes time and public safety resources because police *must* check to see if firearms are unloaded. Battle for the California Desert: Why is the Government Driving Folks off Their Land?

The Antelope Valley is a vast patch of desert on the outskirts of Los Angeles County, and a segment of the few rugged individualists who live out there increasingly are finding themselves the targets of armed raids from local code enforcement agents, who've assembled into task forces called Nuisance Abatement Teams (NATs). The plight of the Valley's desert dwellers made regional headlines when county officials ordered the destruction of Phonehenge: a towering, colorful castle constructed out of telephone poles by retired phone technician Kim Fahey. Fahey was imprisoned and charged with several misdemeanors. But Fahey is just one of many who've been targeted by the NATs, which were assembled at the request of County Supervisor Mike Antonovich in 2006. LA Weekly reporter Mars Melnicoff wrote an in-depth article in which she exposed the county's tactic of badgering residents with minor, but costly, code violations until they face little choice but to vacate the land altogether. "They're picking on the the people who are the most defenseless and have the least resources," says Melnicoff. Reason.tv collaborated with Melnicoff to talk with some of the NAT's targets, such as retired veteran Joey Gallo, who might face homelessness if he's forced to leave his house, and local pastor Oscar Castaneda, who says he's already given up the fight and is in the process of moving off the land he and his wife have lived on for 22 years. And, while Antonovich declined an interview, we did catch up with him at a public meeting in order to ask the big question at the center of all this: Why the sudden enforcement of these codes against people living in the middle of the desert, who seemingly are affecting no one? The Lebec County Water District's June 11, 2013 meeting at which LCWD board president Julie McWhorter stopped the district's public meeting under a misconstrued interpretation of California Government Code Section 54953.6 McWhorter claims that this section permits her to prohibit the public's legal right to photograph with illumination in a public meeting. In fact, section 54953.6 explicitly states that "No legislative body of a local agency shall prohibit or otherwise restrict" the photographing of its public meetings unless the photography causes so much noise, illumination or obstruction of view that it "would constitute a persistent disruption of the proceedings." The Mountain Enterprise does not disrupt meetings in the course of its reporting. The Brown Act explicitly states in section 54953.5 (a): "Any person attending an open and public meeting of a legislative body of a local agency shall have the right to record the proceedings with an audio or video tape recorder or a still or motion picture camera." The only way to remove the public's right under the law would be for the photography to create so much disturbance to the meeting that it causes a persistent disruption, which does not occur when The Mountain Enterprise takes its photographs using flash. This video begins with McWhorter reading into the record the district's actions at its May 14, 2013 meeting, during which McWhorter again violated public meeting laws by conducting a public meeting behind a locked door so members of the local press could not attend.

It was all I could,do not to bust out laughing. I did not have any intention of filming the Board of Equalizaion and Review, but now I will be at EVERY ONE. I will not allow these people to step all over laws and try to switch and change them to suit their needs. They need to STOP lying to the people of this county. This is EXACTLY why commissioners SHOULD NOT sit on this board as a member of our group stated a year ago. It should be a board of citizens, then it would be a PRIVATE meeting and not PUBLIC. Mr. Jordan did not want to relinquish his POWER as a commissioner he stated many times to the citizens. Mr. Jordan please don't try to bluff me. LOL It won't work!
